By accessing or using Clean Paws ("we," "our," or "us") pet waste removal services, you agree to be bound by these Terms of Service. If you do not agree with any part of these terms, you may not use our services.
These terms apply to all visitors, users, and others who access or use our services.
2. Services
Clean Paws provides professional pet waste removal services for residential properties. Our services include:
- Regular scheduled pet waste removal from your yard
- One-time cleanup services
- Recurring service plans (weekly, bi-weekly, monthly)
- Yard deodorizing and sanitization services
Service availability may vary by location. We reserve the right to refuse service to any property or customer at our discretion.
3. Account Registration
When you create an account with us, you must provide accurate, complete, and current information. You are responsible for:
- Maintaining the security and confidentiality of your account credentials
- All activities that occur under your account
- Notifying us immediately of any unauthorized access or security breach
- Ensuring your contact information is current and accurate
4. Service Terms and Conditions
Property Access
By booking our services, you grant Clean Paws permission to access your property for the purpose of providing pet waste removal services. You agree to:
- Provide safe and clear access to the service area
- Secure any aggressive pets during service visits
- Inform us of any hazards or special access requirements
- Maintain gate locks or access codes as agreed upon
Service Schedule
Services will be performed on the agreed-upon schedule. We will make reasonable efforts to maintain consistent service times but cannot guarantee exact timing. Service may be delayed or rescheduled due to:
- Severe weather conditions
- Property access issues
- Safety concerns
- Equipment failures or emergencies
Service Limitations
Our services are limited to pet waste removal from accessible areas of your property. We are not responsible for:
- Waste removal from areas with deep snow, standing water, or other hazards
- Damage to lawns, plants, or property features during normal service operations
- Waste that is frozen to the ground or otherwise impossible to remove safely
- Areas of property not included in the service agreement
5. Payment and Billing
Payment for services is processed through Square, our secure payment processor. By using our services, you agree to:
- Provide current, complete, and accurate payment information
- Promptly update payment information if it changes
- Pay all charges incurred under your account
- Pay applicable taxes and processing fees
For recurring services:
- Billing occurs automatically according to your service plan
- Prices are subject to change with 30 days notice
- You may cancel recurring services at any time with proper notice
- No refunds for partial service periods unless otherwise agreed
6. Cancellation and Refund Policy
Service Cancellations
You may cancel or reschedule individual service visits with at least 24 hours notice. Late cancellations (less than 24 hours) may be charged at 50% of the service fee.
Recurring Service Cancellations
You may cancel recurring services at any time. Cancellations take effect at the end of the current billing period. No refunds are provided for unused portions of the current billing period unless service was not provided as agreed.
Refund Policy
Refunds are provided only in the following circumstances:
- Service was not provided as agreed
- We were unable to access your property through no fault of yours
- Duplicate charges or billing errors
7. Liability and Insurance
Clean Paws maintains general liability insurance for our business operations. However, our liability is limited as follows:
- Property Damage: We are not liable for pre-existing damage to lawns, plants, or property features. Minor surface disruption during normal service operations is expected and not compensable.
- Pet Safety: You are responsible for securing aggressive or escape-prone pets during service visits. We are not liable for pets that escape or become injured during service.
- Maximum Liability: Our total liability for any claim shall not exceed the amount paid for services in the 30 days preceding the incident.
8. Your Responsibilities
As a Clean Paws customer, you agree to:
- Provide accurate property and pet information
- Maintain safe access to service areas
- Secure aggressive pets during service visits
- Notify us of any changes to property access or safety concerns
- Treat our service technicians with respect and professionalism
- Comply with all applicable local laws and regulations
9. Intellectual Property
The Clean Paws website, logo, service marks, and all related content are the property of Clean Paws or its licensors. You may not use, copy, or distribute any of our intellectual property without prior written permission.
10. Dispute Resolution
We are committed to resolving any disputes amicably. If you have a concern:
- Contact us first to discuss the issue
- We will work with you in good faith to reach a resolution
- If we cannot resolve the dispute, we agree to mediation before pursuing legal action
Any legal disputes shall be governed by the laws of the State of New York and resolved in courts located in the Hudson Valley region.
11. Termination
We reserve the right to terminate or suspend your account and access to services immediately, without prior notice or liability, for any reason, including but not limited to:
- Breach of these Terms of Service
- Non-payment for services
- Abusive or threatening behavior toward our staff
- Unsafe property conditions
- Providing false or misleading information
12. Modifications to Terms
We reserve the right to modify or replace these Terms of Service at any time. We will provide notice of any material changes by:
- Posting the updated terms on our website
- Updating the "Last Updated" date at the top of this page
- Sending email notification to active customers for significant changes
Your continued use of our services after any modifications indicates your acceptance of the updated terms.
13. Severability
If any provision of these Terms is found to be unenforceable or invalid, that provision will be limited or eliminated to the minimum extent necessary so that these Terms will otherwise remain in full force and effect.
14. Entire Agreement
These Terms of Service, together with our Privacy Policy and any service-specific agreements, constitute the entire agreement between you and Clean Paws regarding our services.
